What is a Trademark?
Trademarks can consist of words, including personal names, numbers, colors, letters, numbers, voices, and any kind of characters, including types of goods and packages, provided that goods or services from one company are distinguished from goods or services from another company and that can be identified in the register in such a way that the subject of the protection provided for the trademark owner is clearly and precisely understood. The most crucial criterion for trademarks is the obligation to have a "distinctive character " that helps differentiate the indication used from similar goods and services.
What is an Invention?
An invention is a new solution to a technical problem and can be protected. Innovation means developing something new that improves a machine ,product or a new process creating an object or result. This applies for all branches of industry,inclusive agriculture.
What is a Patent?
An invention uses technology to solve a specific problem. The technical character is necessary for applying for a patent. A patent is the granting of a property right by an offical IP authority to an inventor. This grant provides the inventor exclusive rights to the patented process, product or device for a designated period in exchange for a comprehensive disclosure of the invention. The period of protection is 10 years if it is a Utility Model and 20 years if it is an examined patent application. There is no non-examined patent type in the Intellectual Property Rights Code anymore ;only applications made before January 10, 2017 will be processed according to the Statuary Decree on these type of patent applications.
What is a Design?
Design is a visual perceipten of various objects or features, including stripes, figures, shapes, fabrics of a whole or partial product . Generally speaking, it is the process of envisioning and planning the creation of objects, interactive systems, buildings, vehicles, etc. A design right offers an exclusive right to its owner on the appearance itself of the product.
Why is Trademark Registration Required?
If there is a concern that the trademark you use is imitated - distinctive - you should apply to TURKPATENT for its registration as soon as possible. Other real or legal persons may apply for the registration of your trademark before you and may cause you loss of rights and time. If your trademark meets the registration criteria, it will be registered and protected for ten years. With the renewal request you make at the end of each decade, you will be able to extend the protection period as much as you want.
