Updates to EAPO Patent Instruction: Changes Effective January 1, 2024

On January 1, 2024, amendments to the Patent Instruction of the EAPO entered into force. The main changes concern the establishment of a deadline for the submission of the invention claims, which is not present in the received EAPO materials of the Eurasian application, changes in the deadlines for submitting objections within the framework of the procedure for the administrative annulment of Eurasian patents. An expanded list of checks conducted by EAPO in relation to the declared industrial design within the framework of the examination of the Eurasian application on the merits. Also provided is the possibility of settlement of the dispute by means of the mediation procedure in case of identity or similarity to the degree of confusion of the industrial design with trademarks with earlier priority.
