SAIP Introduces Strict New Trademark Application Procedures with Elimination of Grace Period

Please be aware that the Saudi Authority for Intellectual Property (SAIP) has recently implemented several amendments to its procedures, marking a significant shift in Saudi Arabia's approach to IP protection and bolstering the efficiency of its management system. Among the latest changes introduced by SAIP is the elimination of a 10-day grace period for applicants to amend refused trademark applications. Instead, SAIP now issues outright rejections for trademarks that fail to meet both formal and legal requirements during examination, offering applicants only one recourse: filing appeals with the Appeals Committee within a non-extendable 60-day period. Consequently, trademark applicants are strongly advised to exercise utmost accuracy and diligence in evaluating all potential scenarios prior to submitting their trademark applications to mitigate the risk of rejection.
